Summary of the brief to the National Assembly’s Commission on Institutions on Bill 60, Charter affirming the values of State secularism and religious neutrality and of equality between women and men, and providing a framework for accommodation requests

The Commission expresses its concerns on the impacts of Bill 60, which will superimpose a new Secular Charter on the Québec Charter of Human Rights and Freedoms. This Bill represents a clear setback for rights and freedoms and risks creating more opportunities for conflict in Québec society particularly as it relates to the interpretation of the duty to accommodate and the prohibition of discrimination in employment. The detailed legal analysis concludes that most of the provisions should not be adopted or should be modified to comply with the Québec Charter of Human Rights and Freedoms, a quasi-constitutional law.
